1. Parties to the contract

This contract is formalised between ProturVillas (hereinafter the Lessor), owner of the holiday properties, and the client making the booking (hereinafter the Lessee).

The Lessee declares to be of legal age and to act on their own behalf or with sufficient authority to contract on behalf of the group.

2. Object of the contract

The object of this contract is the holiday rental for tourist use of the selected villa, for the period between the check-in and check-out dates stated in the booking confirmation.

Use is strictly limited to the guests declared at the time of booking. Subleasing and transfer to third parties are not permitted.

3. Booking and confirmation

The booking is considered firm once written confirmation has been received from ProturVillas. Submitting the enquiry form does not guarantee availability nor constitute a binding contract until both parties agree and confirm the terms.

ProturVillas reserves the right to refuse any booking request without justification.

4. Price and payment

The rental price will be communicated in writing before booking confirmation. The price includes use of the villa and its facilities during the agreed period.

• Deposit (30%): Upon booking confirmation.
• Final payment (70%): At least 30 days before check-in.
• Security deposit: Up to €2,000 refundable, returned within 7 days after check-out following inspection.

5. Cancellation policy

• More than 60 days before: Loss of 30% (deposit).
• Between 30 and 60 days: 50% of total amount.
• Less than 30 days: 100% of total amount.

Travel insurance is recommended. ProturVillas is not responsible for circumstances beyond its control (force majeure, strikes, natural disasters).

6. Check-in and check-out

Check-in time is from 16:00 and check-out before 11:00. Time changes are subject to availability and must be agreed in advance.

The Lessee must present identity documents for all guests over 16 years of age, in accordance with current tourist regulations.

7. Capacity and rules

The maximum number of occupants is as stated for each villa. Exceeding this limit may result in immediate termination without refund.

• Parties or events without express authorisation are prohibited.
• Pets are not allowed unless agreed in writing beforehand.
• The Lessee is responsible for any damage caused during their stay.
• Quiet hours must be observed from 23:00.

8. Liability

ProturVillas is not responsible for accidents, injuries or loss of personal belongings during the stay. The Lessee uses the facilities (pool, garden, etc.) at their own risk.

ProturVillas guarantees that the villa will be delivered in perfect habitable condition with all described services operational.

9. Data protection

Personal data will be processed in accordance with Regulation (EU) 2016/679 (GDPR). The purpose is booking management and client communication.

Data will not be shared with third parties unless legally required. You may exercise your rights of access, rectification and erasure by contacting [email protected].

10. Applicable law

This contract is governed by Spanish law. For any dispute, the parties submit, waiving their own jurisdiction, to the Courts of Palma de Mallorca.
